Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Travmo mobile application, website at travmo.in, and related services (the “Services”) operated by Travmo (“we”, “us”, “our”). By creating an account, downloading the app, or using the Services, you agree to these Terms and our Privacy Policy.
1. Eligibility
You must be old enough under the laws of your jurisdiction to enter a binding agreement and to use the Services without parental consent where required. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation.
2. Accounts
You may need an account to access certain features. You agree to provide accurate information and keep credentials secure. You are responsible for activity under your account. Notify us at support@travmo.in if you suspect unauthorised access.
3. Licence to use the Services
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to use the Services for your own non-commercial purposes (or as otherwise permitted in writing). You may not copy, modify, distribute, sell, or lease any part of the Services except as allowed by law or with our consent.
4. User content
You may upload or create content (such as trip notes, photos, or profile information) (“User Content”). You retain ownership of your User Content. You grant us a worldwide, non-exclusive licence to host, store, reproduce, adapt, display, and distribute User Content solely to operate, improve, and promote the Services, including security and backup. You represent that you have the rights needed to grant this licence.
We may remove content that violates these Terms or that we are required to remove by law. We are not obligated to store or return User Content.
5. Acceptable use
You agree not to:
- Use the Services unlawfully, to harass others, or to distribute malware;
- Attempt to gain unauthorised access to our systems, other users’ data, or third-party services;
- Scrape, overload, or interfere with the Services or circumvent technical limits;
- Misrepresent your identity or affiliation, or use the Services to send spam or deceptive communications;
- Use the Services in a way that infringes intellectual property or privacy rights of others.
We may suspend or terminate access for violations.
6. Third-party services
The Services may integrate or link to third parties (maps, booking sites, social platforms, payment processors, Apple App Store, etc.). Your use of those services is subject to their terms and policies. We are not responsible for third-party content, availability, or practices.
7. Travel information and packages
Information about places, prices, hours, routes, or packages may come from third parties or users and may be incomplete or outdated. Offers and “packages” may be provided by partners or aggregators; final terms, taxes, and availability are determined at booking. Always confirm critical details directly with providers.
8. Intellectual property
The Services, including branding, design, software, and documentation, are protected by intellectual property laws. Except for your User Content and rights expressly granted here, we and our licensors reserve all rights.
9. Fees
Some features may be free; others may require payment or a subscription. Prices and terms will be presented in the app or on the website. App Store purchases are processed by Apple under Apple’s terms.
10. Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.
11. Limitation of liability
To the fullest extent permitted by law, we and our affiliates, directors, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill, arising from your use of the Services or travel decisions based on the Services.
Our total liability for claims arising from the Services is limited to the greater of (a) the amount you paid us for the Services in the twelve months before the claim, or (b) one hundred Indian rupees (INR 100), except where liability cannot be limited under applicable law (for example certain consumer protection rules).
12. Indemnity
You will defend and indemnify us against claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your misuse of the Services, or your violation of these Terms or applicable law.
13. Suspension and termination
We may suspend or terminate your access to the Services at any time, with or without notice, for conduct we believe violates these Terms or harms other users or us. You may stop using the Services at any time. Provisions that by nature should survive (disclaimers, liability limits, indemnity, governing law) will survive termination.
14. Changes
We may modify the Services or these Terms. We will post updated Terms on this page and update the “Last updated” date. Continued use after changes become effective constitutes acceptance. If you do not agree, stop using the Services.
15. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts located in India shall have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence where they cannot be waived.
